Pathways and lawyer assistance in Melbourne
Which partner pathway fits?
Your location when applying determines which starting route to check; decision-location rules are separate. A Melbourne-based sponsor can have an offshore applicant.
The 820 pathway and 309 pathway require an eligible sponsor and a genuine married or de facto relationship, alongside other requirements. Marriage alone does not establish eligibility.
The temporary or provisional stage leads towards permanent-stage assessment, not automatic permanent residence. Home Affairs distinguishes eligibility for the 801 permanent stage and 100 permanent stage from the time taken to process them.
An intention to marry is a different starting point: the 300 visa involves marriage followed by a separate partner visa application.
What does a partner visa lawyer in Melbourne do?
A migration lawyer can turn your visa history, relationship records and Department correspondence into a focused assessment and preparation plan. The task table separates that legal analysis from your responsibility to provide truthful, complete information.
Practical help includes identifying an application restriction before lodgement, explaining an evidence gap and checking whether a proposed response addresses the Department’s actual concern. It cannot guarantee an outcome or accelerate processing.
Ask for the work covered, exclusions, basis of charging and anticipated legal costs in writing, consistent with Victorian consumer costs guidance. See Partner Visa Lawyer Fees: Scope for Melbourne Enquiries for the distinction between assessment, application preparation, response and review work.
| Task | Applicant or sponsor responsibility | Concrete lawyer contribution |
|---|---|---|
| Pathway and status | Provide visa grants, conditions, location and relationship history. | Identify application restrictions and distinguish application validity from grant criteria. |
| Relationship evidence | Provide accurate records and explain gaps or inconsistencies. | Map evidence to the relevant assessment areas and identify missing explanations. |
| Department notice | Supply the complete notice and supporting records promptly. | Analyse the issue, organise a targeted response and check the stated timeframe. |
| Refusal | Provide the decision and notification details. | Assess available review options and the applicable deadline without assuming review rights. |
How does application preparation work?
Preparation works best when status and eligibility checks come before document collection.
- Check your current visa and location. Use Visa Entitlement Verification Online to check current visa details and conditions, and keep your grant notices available.
- Assess applicant and sponsor requirements. Work through the relevant pathway rather than assuming marriage or living together is enough; the 820 instructions identify eligibility and application restrictions.
- Organise relationship records. Group evidence around financial arrangements, household life, social recognition and commitment, the relationship assessment areas in the Migration Regulations. Explain gaps rather than aiming for a fixed photograph count.
- Prepare checks, translations and stage-specific forms. Follow Home Affairs family application guidance. Form 888 is a supporting witness statement, not a substitute for required Commonwealth statutory declarations. The 820 instructions specify declarations for certain applicants without a substantive visa; these application-validity requirements are distinct from Schedule 3 grant criteria. The sponsor declaration required at the 801 stage is a separate stage-specific document, not a rule to transfer automatically to the 100 pathway.
- Check consistency and retain records. Compare names, dates and explanations across forms and evidence before submission, then retain the submitted version and receipts. Follow the official document attachment instructions.
What makes a matter complex?
Restrictions, uncertain visa status, conflicting evidence, relationship changes and refusals need individual assessment rather than a general pathway answer.
- Visa restrictions: a No Further Stay condition may restrict further applications. A waiver request is not a granted waiver and does not extend lawful stay, as Home Affairs explains.
- Evidence inconsistencies: unexplained differences in dates, addresses or relationship accounts need reconciliation, not simply more documents.
Safety and relationship changes
If you are in immediate danger, call 000. For family violence crisis support in Victoria, contact Safe Steps on 1800 015 188, available around the clock through Victorian statewide support services.
Separation does not automatically end every possible pathway or automatically allow continuation. Home Affairs identifies distinct branches involving family violence, sponsor death and qualifying shared-child arrangements in its partner visa overview; the applicable criteria and evidence must be assessed.
Status and refusal issues
- No substantive visa: check application validity separately from additional Schedule 3 grant criteria under the 820 instructions and Migration Regulations.
- Refusal: read the decision notice promptly to establish review availability and the exact deadline. The Administrative Review Tribunal explains that migration review time limits cannot be extended. See Partner Visa Refusal: Review and Lawyer Help in Melbourne.
How do you respond to Department requests?
Respond to the issues in the notice, not with an unrelated bundle of relationship evidence.
- Read the whole notice, including attachments and submission instructions.
- Address each stated issue with relevant evidence and explanations that reconcile conflicting records.
- Check the stated timeframe and retain proof of submission; follow Home Affairs’ document attachment guidance.
Distinguish a request for missing information from a notice inviting comment on adverse information. The first calls for the identified material; the second needs a response to the concern described in the notice. A lawyer can test whether your response answers that concern clearly. Do not assume an extension is automatic; use the notice and official partner application guidance to manage the response.
Under sections 56–58 of the Migration Act 1958, a section 56 request invites additional information, while section 57 concerns certain information relevant to a possible refusal and an invitation to comment. Section 58 addresses the response method and period specified in the invitation. Check the actual notice before preparing the reply.
How do Melbourne and Victoria affect the documents?
Melbourne does not have separate partner visa eligibility rules: the onshore and offshore pathways are federal. Victoria affects some document processes.
| Document or process | Official route and important distinction |
|---|---|
| Victorian relationship registration | Apply through Births, Deaths and Marriages Victoria. Registration may affect the de facto duration requirement where applicable under the partner rules, but does not prove every relationship criterion. |
| Registered marriage certificate | Obtain the legal certificate through the Victorian marriage certificate service; the ceremony memento is not the registered certificate. |
| Australian police check | Home Affairs specifies an Australian Federal Police National Police Check with purpose code 33. Use the official Australian Federal Police application route, not an ordinary state police employment check. |
| Health examinations in Australia | Follow the required examinations and health referral identifier supplied by Home Affairs, then book with Bupa Medical Visa Services through the official health examination instructions. |
Which partner visa help is available?
Enquiries can focus on:
- pathway and current-status assessment;
- relationship evidence preparation;
- a targeted response to Department correspondence;
- refusal and review assessment.
Legal fees cover the agreed legal work. Government charges, checks, translations and other application expenses are separate categories.
This page quotes no current visa charge or processing estimate. Use the Home Affairs visa pricing estimator for your pathway and applicant circumstances, and the official processing guide for published information. Those processing figures describe recently decided applications, not a prediction for yours.
For a pathway or preparation enquiry, outline your current visa, where the applicant is located and the issue you need assessed. A migration lawyer can identify application restrictions and evidence gaps before you take the next step. Enquiries through this guide go to Australian Migration Lawyers; careful preparation does not guarantee a visa outcome. Do not send identity documents or sensitive evidence in an initial enquiry.
